Cases are typically divided into two categories. Criminal and civil. While there can be civil assault law cases, they are typically done in the criminal arena.

The prosecution is required to prove each and every element of the offense according to the statute.

Assault law requires that the victim actually be touched or contacted by the assailant. Merely putting the victim in fear of assault does not amount to an assault law case.

In some instances, an assault law case may be a civil case if the assault takes place in the work environment.
